The Child-Free Act of Oregon, USA requires the manufacturers of children's products sold in Oregon to declare if the contact or non-contact parts of the products contain one or more chemicals of great concern to children's health (HPCCCH), and if the concentration is intentionally greater than or equal to the actual quantitative limit (PQL) or the content as a pollutant is greater than or equal to 100ppm.
On July 27, 2023, the Governor of Oregon approved the HB 3043 Act, which revised the regulations related to chemicals in children's products and came into effect on January 1, 2024. The following amendments are further amendments based on the Oregon Drug-Free Children Act passed in 2015:
The definition of "chemical substance category" has been added. The authorities can now supervise a class of chemicals on the list instead of one by one.
Manufacturers of children's products containing chemicals or a class of chemicals with a specified limit or above shall submit a biennial declaration to the Oregon Health Bureau (OHA) before January 31st of each applicable declaration year.
The brand name and model of the product are added in the declaration, which will take effect on January 1, 2025; The product brand name and model should be added in the declaration on or after January 31, 2026.
Deleted the provision that OHA is prohibited from adding more than five chemicals to the list of chemicals of high concern to children's health (HPCCCH).Hazard assessment is valid for three years from the date of submission.
