On July 11th, 2023, the 16th amendment to EU Regulation 10/2011 on food contact with plastics and articles was published in the Official Gazette of the European Union.
Regulation EU2023/1442 amended the list of authorized substances in Annex I of EU10/2011. The specific migration limits (SML) of five phthalates were modified: benzyl butyl phthalate (BBP, CAS 85-68-7), dibutyl phthalate (DBP, CAS 84-74-2), di (2- ethylhexyl) phthalate (DEHP, CAS 117-81-7). SML reduction is as follows:
(1)DEHP decreased from 1.5mg/kg to 0.6 mg/kg;
(2)DBP decreased from 0.3mg/kg to 0.12 mg/kg;
(3)BBP was reduced from 30mg/kg to 6mg/kg;;
(4) The sum of 4)DINP and DIDP decreased from 9mg/kg to 1.8mg/kg.
This new regulation further cancels the authorized use of salicylic acid (FCM No.121) and untreated wood flour and fiber (FCM No.96). In addition, it added five new authorized substances to the EU list.
The new regulations came into effect on August 1, 2023. Plastics and articles that meet the requirements of RegulationNo. 10/2011 applicable before August 1, 2023 and are first put on the market before February 1, 2025 may continue to be put on the market until the stocks are exhausted.
